Car Hire Terms and Conditions
1. Purpose
This policy sets out the terms and conditions for the hiring and use of Drive Smart Driving School vehicle. It ensures the safety of learners and instructor, compliance with legal requirements, and protection of school asset.
2. Scope
This policy applies to:
2.1 Driving instructors using Drive Smart vehicles for lessons
2.2 Learner drivers hiring a school vehicle for practice or driving tests
2.3 Any authorised person using the vehicle for business purposes
3. Eligibility
To hire/use a vehicle:
3.1 Learners must hold a valid learner/restricted/full driver licence
3.2 Instructors must hold a current driving instructor's licence and meet legal requirements
3.3 The hirer must comply with all road rules, insurance, and safety conditions
4. Vehicle Use
4.1 Vehicle is to be used only for driving lessons, driving tests, or other authorised business purposes.
4.2 Vehicles must not be used for private or non-school-related purposes unless authorised in writing.
4.3 Smoking, vaping, or consuming alcohol/drugs in vehicles is strictly prohibited.
4.4 Seatbelts must be worn at all times by all occupants.
5. Booking & Hiring Conditions
5.1 Vehicles must be booked in advance.
5.2 A minimum notice period applies for cancellations (e.g., 24 hours). Late cancellations may incur a fee.
5.3 Vehicles hired for driving tests will be subject to availability and confirmation by the school.
6. Fees & Payment
6.1 Hiring fees are set by Drive Smart Driving School and communicated prior to booking.
6.2 Fees must be paid in full before vehicle use.
6.3 Additional charges may apply for:
6.3.1 Late cancellations.
6.3.2 Damage caused due to negligence.
6.3.3 Cleaning if the vehicle is returned in an unacceptable condition.
7. Insurance & Liability
7.1 Drive Smart Driving School vehicle is fully insured; however, the hirer may be liable for the insurance excess if damage occurs due to negligence, reckless driving, or breach of this policy.
7.2 Drive Smart Driving School is not liable for fines, penalties, or legal costs incurred by the hirer.
8. Safety & Maintenance
8.1 Vehicle is regularly maintained and inspected by Drive Smart Driving School.
8.2 Any issues or damages must be reported immediately to the school.
8.3 Hirers must check fuel, mirrors, and general vehicle condition before use.
9. Code of Conduct
9.1 Hirers must respect instructor, examiner, and other road users.
9.2 Aggressive, reckless, or unsafe driving will result in termination of the hire and possible banning from future use.
10. Breach of Policy
Failure to comply with this policy may result in:
10.1 Refusal of future vehicle hire.
10.2 Recovery of costs for damages.
11. Acknowledgement
All hirers must sign a Car Hire Agreement Form confirming they have read, understood, and agreed to this policy before using a Drive Smart vehicle.
